CharlesCharles Peck being, also duly sworn on, by oath saith, that
he was present when JamesJames to Samuel B SmithSamuel B Smith ,
a copy of the award on the Back of which is endorsed, the affidavit
of EphraimEphraim Tour, and asked him whether he would accept of
and abide, by the same that he the said SamuelSamuel B Smith B SmithSamuel B Smith ,
then declared that he could not - that he the said James FernonJames Fernon ,
there as left him if could come to a settlement of their
business, and the said SmithSmith , declined giving him an answer,
and further saith not
