1. That unless the jury find from the evidence that
the plaintiff was held in slavery orrestrained
of his liberty by the defendent at the time of
the commencement of this writ
the plaintiff cannotrecover in this action -


2. That if the jury shall be of opinion that the
plaintiff is entitled to his freedom stillissue
they also find that he has been held in
slavery by the defendant since that
to freedom accrued the plaintiff can not
recover in this action - -


3. Unless it appear to the jury by the evidence in the
cause, that the defendant Coleman DuncanColeman Duncan
did restrain the plaintiff of his liberty on this
state the plaintiff cannot recover in this action --
