And for a further plea in this behalf the said
JamesJames Newton says that the said LewisLewis ough
to be barred and precluded from
having & maintaining his action aforesaid
against the said JamesJames because he says
that the said LewisLewis at the time of the com-
mencement of his action aforesaid was &
still is a slave, without this that the said
LewisLewis at the said time was a free person-
as in & by his declaration is above suppose
and of this he puts himself upon the Country
&c
