Be it remembered
that on the 16th of October in the year eighteen hundred and forty four the defendant
by his attorney made his motion
to strike out the Bill of exceptions in this case
as no part of the record & filed his filed his reasons
therefor & affidavits in support
thereof which are in the
words & figures following (here insert
the motion and reasons & affidavits)

The Court overruled this motion
to which decision of the Court the
defendant by his counsel excepted
and prays the Court to sign & seal this
his Bill of exceptions which is
done accordingly this sixteenth day of October eighteen hundred forty four.
