If the jury find from the evidence that
the defendant did not hold or detain
the plaintiff otherwise than as sheriff
and by virtue a writ of execution to him
directed that at the time of the levy
the plaintiff was held as a slave
by the defendant in the execution, the
jury ought to find for the defendant
in this action
