states that MiltonMilton Duty in his
life
time placed several promissory notes in the hands of this
depo
nent for collection the nett proceeds
of which were all paid
to said
MiltonMilton Duty or to his order except
the sum of five
hundred & forty four
dollars & 70 cents which sum
of
five hundred & forty four 70 dollars
was paid by
this deponent to HenryHenry
Hernandez administrator of said MiltonMilton
Duty - the said payment having
been made on the 17th day of May
1839.
This deponent further states that
the Planters
Bank of the State of Missi
placed in the hands of this deponent
of
his partner JosephJoseph Holt, for
collection a promissory note executed
by MiltonMilton Duty, John Henderson
&
John Templeton for
the payment
of eleven hundred & eighty two 54/110
dollars
dated 22nd May 1837 &
due ten months after 23rd May 1837
that
afterwards by an arrange
ment made between the said John
Henderson
& RobertRobert Riddle Eqr the
cashier of the Branch of said
Bank at this place the said
promissory note was delivered
up to
said John Henderson - he
being a surety on the note - suit
had
been instituted on the said note.
