The plaintiff moves the court to set aside the nonsuit
and grant a new trial in the above entitled cause for
the following reasons, viz.
1. That the Court improperly excluded on the trial
legal & competent evidence offered by the plaintiff
2. That the Court improperly refused to allow the motion
made on behalf of the plaintiff for a rule or
the Judge of Probate to produce in Court a word
being necessary evidence for the plaintiff
