Refused

Even if the Jury are satisfied
from the evidence that the Defendant
procured an order from the Sheriff on
the Jailor for the delivery of the slaves
to the plaintiff when the latter should
call for them, and the Jailor promised
to comply therewith, get if when applied
to for that purpose he refused to deliver
them to the Plaintiff, the mere fact of
such promise, unaccompanied by any
evidence that the Plaintiff accepted or
treated the same as a delivery, would
not constitute a delivery.
