Francis Leclere, by his attorney complains of
AntoineAntoine Cebleau CebleauAntoine Cebleau , of a plea of Trespass a upon
the case, for that whereas, the said AntoineAntoine
on the first day of day of July in the year one thousand eight hundred and eighteen at the
county of St LouisSt Louis aforesaid was indebted to the
said Franicis in the sum of one hundred
and three dollars forty cents lawful money
of the United StatesUnited States for so much goods,
wares and much and &
furs before that time had and by
the said Antoin, and to him sold and
at his special, instance and request
by the said FrancisFrancis and he being so
indebted be the said AntoineAntoine afterwards,
to wit, on the same day and year last
aforesaid at the county aforesaid undertook
and then and there faithfully promised
the said FrancisFrancis to pay him the said
sum of money when he should be

thereto afterwards requested

and whereas also, the said Antoin
afterwards, to wit on the said first day of July in the year one thousand eight hundred and eighteen at the county, aforesaid
with the said FrancoisFrancois of and concerning
divers, other sums of money from the said
Antoin to the said FrancoisFrancois before that
time due and owing and then in arrears,
and unpaid, and upon such accounting
the said antoine was then and there
found to be in arrear and indebted to the
said FrancoisFrancois in the further sum of one
hundred and three dollars and forty
cnts like lawful money of the N States,
and being so found in arrear and
indebted to the said FrancisFrancis he the
said AntoineAntoine then and there in consideration,
thereof and undertook and faithfully
promised to pay him the said FrancoisFrancois , the
said last mentioned sum of money

when he should be afterwards
requested.

never theless, the said Antoin not regarding
his said several promises and undertakings
but and fraudulantly intending
and to deceive and
the said FrancoisFrancois , in this behalf
hath not as yet paid the said several
sums of money, or any, or other, or any
part thereof to the said FrancoisFrancois , althought
often requested so to do, but to pay the
same the said AntoineAntoine hath hitherto,
wholly refused, and still refuses, to the
damage of the plaintiff of two
hundred, and fifty dollars, and
therefore he brings suit

Before me ArchArchibald Gamble ,GambleArchibald Gamble is given Clerk
of the Circuit CourtCircuit Court for the county aforesaid
personally came and appeared Francois LeclereFrancois Leclere ,
and made oath that that there is a
real subsisting debt due and owing to
him from AntoineAntoine Sitoliur, to the amount
of one hundred and three dollars and
forty cents, and that he verily beieves
the said Antoin ought to be held to
bail in the sum of two hundred dollars
to serve, the payment of said debt,
interests & costs,

On the foregoing appear
wit the sheriff is ordered
to hold the defendant AntoineAntoine
to bail in the sum
of two hundred dollars

And now at this day
comes the defendt by his Attorney and
defends the wrongs & injury when & c and saith
that he did not promise & assure, in
manner & form as the plaintiff hath
above complained of against him &
of this he puts himself upon the county

October next, to answer unto Francois LeclereFrancois Leclere ,
a plea of trespass, upon the case to the damage
of FrancoisFrancois two hundred fifty dollars
and if judgment be given against him at the or any subsequent

pay the damages, aforesaid and costs, or the amount
of he condemnation of the court, or surrender himself in execution there
