ClarkWilliam Clark of a plea of trespass on the case for that
whereas heretofore to wit on the twentieth day of March in the year eighteen hundred and thirty
at LouisvilleLouisville to wit at the County aforesaid
the said William ClarkWilliam Clark made his promissory
note in writing bearing date the day and year
aforesaid and thereby then and there promised
thirty days after the date thereof to pay to Dan
iel Combs or order the sum of two hundred
and eighty one dollars and twenty nine cents
for value received and then and there delivered
the said promissory note to the said Combs and
the said DanielDaniel Combs to whom or to whose
order the said sum of money in the said prom-
issory note specified was to be paid, after the
making of the said note and before the payment
of the said sum of money therein specified to writ
on the nineteenth day of June in the year eighteen hundred and thirty at LouisvilleLouisville to writ at the
County aforesaid by his endorsement in writing
on the said promissory note assigned the same
for value received to the said plaintiffs by the
name and description of âJ & W Stewartâ and
then and there delivered the said note to the said
plaintiffs which said note and assignment are now in court showed of which said assignment he the said
Defendant afterwards to writ on the day and year
last aforesaid at the County aforesaid had notice
Nevertheless the said William ClarkWilliam Clark although

often requested hath not paid the said sum of
money in the said promissory note specified either
to the said DanielDaniel Combs before the assignment as
made by him as aforesaid or to the said plain-
tiffs since the said assignment but to pay the
same hitherto hath and still doth altogether
refuse to the damage of the said plaintiffs
of five hundred dollars and therefore they sue &c

-ant in the foregoing declaration is justly indebt
ed to Isaac StewartIsaac Stewart and Willis StewartStewart the
plaintiffs in said declaration in the sum of
two hundred and ninety two dollars for the cause
of action in said declaration set forth and that
this affiant verily believes that the said WilliamWilliam Clark
ClarkWilliam Clark is not a resident of or residing within
the State of MissouriMissouri

St. Louis Circuit CourtCircuit Court,
November term, 1831.

On motion of the said plaintiffs, by their attorney, it is
ordered, that the said Wm. ClarkWilliam Clark be notified, that
an action of assumpsit, damages Five hundred dollars, has
been commenced against him by the said Isaac StewartIsaac Stewart ,
and Willis StewartStewart , that a writ of attachment has issued
against his estate, and that unless he be and appear at the
next March term of this court, and plead to the action
aforesaid, according to law, a judgment will be entered
against him, and his said estate sold to satisfy the same;
and it is further ordered, that a copy of this order be in-
serted for four weeks, successively, in some newspaper
published in the city of St. LouisSt Louis, and at least twenty
days before the next March term of this court.

The Condition of the above obligation is such
that whereas the said Isaac StewartIsaac Stewart and Willis Stew
art at the last March Term of the Circuit Court
of the County of St LouisCounty of St Louis recovered a judgement against
William ClarkWilliam Clark for the sum of three hundred and
fourteen dollars and ninety cents damages on an action of
assumpsit commenced by attachment Now if the
said William ClarkWilliam Clark shall within three years next
following this date by himself or Attorney appear in
said Circuit CourtCircuit Court and disprove or avoid the dama
-ges recovered against him or any part thereof then
if the said Isaac StewartIsaac Stewart and Willis StewartStewart
shall pay unto the said William ClarkWilliam Clark all
such sum or sums of money as shall appear
to have been recovered by and not justly due
and owing to them the said Isaac StewartIsaac Stewart and
Willis StewartStewart together with such damages as
shall be assessed by a jury the above obligation
shall be void else shall remain in full
force
