The Plaintiff, a
Corporation duly incorporated by the
laws of the State of MarylandMaryland,
who sues to the use of LouisaLouisa (a
woman of Colour) states that about
eighteen years ago, to wit: about the seventh day of March eighteen hundred and thirty six, the said LouisaLouisa (a woman
of Colour) being then owned and posses
sed as a slave by the Plaintiff, and
the Plaintiff being at that time indebt
ed to the Defendant Francis B. JamesonFrancis B Jameson ,
for money advanced by him for the Plain
tiff an agreement was then entered
into between the Plaintiff and the
Defendant Francis B. JamesonFrancis B Jameson
that the said LouisaLouisa should serve
him (the Defendant Francis B. Jame
son) for five years to pay the sum
of two hundred and fifty dollars
for money so advanced, and that
at the expiration of the said five
years she was to be free; that one
of the moving considerations in said
agreement was the express stipula
tion that the said LouisaLouisa was to be
free at the expiration of the said

five years, and that the Defendant
Francis B. JamesonFrancis B Jameson should man
umit and emancipate her at the ex
piration of the said five years; that
by virtue and in pursuance of said
agreement and the said express
stipulation the Plaintiff trans
ferred and delivered the said LouisaLouisa
into the possession of the De
fendant Francis B. JamesonFrancis B Jameson at
the time aforesaid, and she then
commenced Serving him; that
the said Defendant Francis B. Jame
son was then a resident of the State
of MarylandMaryland and continued to be
a resident of said State between
five and six years thereafter, du
ring all of which time the said
LouisaLouisa continued to serve him;
that he then changed his residence
to the State of MissouriMissouri and re
moved her with him to the said
State, where he has since resi
ded and now continues to reside.

Plaintiff further states
that the said LouisaLouisa faithfully
served the Defendant Francis BFrancis B Jameson .
JamesonFrancis B Jameson until the expiration of the
said five years, and that she was,
at the expiration of the said five
years, and still is, entitled to her
freedom, and to manumission
and emancipationby the Defen by
virtue and in pursuance of the
agreement and express stipulation

aforesaid; but that she has ever since
the expiration of the said five years
as aforesaid been wrongfully and illegallyheld in Slavery
and claimed as a slave and is now wrongfully and illegally
held in Slavery and claimed as a
Slave, by the Defendant FrancisFrancis B Jameson B. JamesonFrancis B Jameson .

Plaintiff further states that
during most or all of the time since
the removal of the Defendant FrancisFrancis B Jameson
B. JamesonFrancis B Jameson from the State of MaryMary
land to the State of MissouriMissouri, to wit:
Between eleven and twelve years
the said LouisaLouisa has been hired, and
is now hired by the Defendant FrancisFrancis B Jameson
B. JamesonFrancis B Jameson to the Defendant EdmundEdmund H McCabe
H. McCabeEdmund H McCabe , of the City and CountyCounty of St Louis
of St. LouisCounty of St Louis, and State of MissouriMissouri
aforesaid in virtue of which she is
now in the possession of the Defend
ant EdmundEdmund H McCabe H. McCabeEdmund H McCabe and wrongfully and illegally held
by him in slavery; that she has
been and is, hired as aforesaid at the
rate of ninety six dollars per
year, out of which it was agreed
her clothing and bills for medical
attendance should be paid; that
but little medical attendance
has been required, which has been
rendered free of charge by the
Defendant EdmundEdmund H McCabe H. McCabeEdmund H McCabe
who is a Physician; that the
cost of clothing has not exceeded
the average sum of
dollars per year.

Plaintiff further states

that the agreement above setforth, in
terms as set forth, and upon the express
stipulation as set forth, was entered in
writing upon the books of the Plaintiff,
so being a corporation as aforesaid,
at the time the said agreement was
made between the Plaintiff and the
Defendant Francis BFrancis B Jameson . JamesonFrancis B Jameson as
aforesaid; that examination of said
books was made within a few years
thereafter, and has since been made
and inquiry also made of the proper
offices, but that the said books had been
burned and destroyed, and torn and
defaced so that the said agreement
so entered in writing as aforesaid,
could not be found, and so that no
record of that date could be found;
and that Plaintiff cannot, therefore,
produce such writing.

Plaintiff further States
that an instrument of writing was
given by the Plaintiff to the Defend
ant Francis B. JamesonFrancis B Jameson , at the time
of the making of the said agreement,
stating the same as above set forth
and the express condition and proviso
that the said LouisaLouisa at the expira-
tion after the said five years was to be
free as aforesaid, and that the
consideration in giving said in
strument of writing was the express
stipulation that the said LouisaLouisa
was to be free at the expiration

of the said five years, and that the
Defendant Francis BFrancis B Jameson . JamesonFrancis B Jameson should
manumit and emancipate her at
the expiration of the said five years

Plaintiff asks that the de
fendant Francis BFrancis B Jameson JamesonFrancis B Jameson may be
compelled by the judgemnet of this
Court to specifically excute and
perform the said agreement and
to manumit and emancipate the
said LouisaLouisa , and further that he may
be compelled to render an account
and make payment for the value
of the service of the said LouisaLouisa
beyond the said five years as a-
forsaid, during the illegaldenten-
tion of the said LouisaLouisa by the said
Defendant Francis BFrancis B Jameson . JamesonFrancis B Jameson so
wrongfully committed as aforesaid.

Plaintiff further asks that
the said EdmundEdmund H McCabe HEdmund H McCabe .McCabeEdmund H McCabe be
made a party defendant to this
petition, and that he be required
to answer the same; and further
that he may be compelled to render
an account of the value of the
service of the said LouisaLouisa during
the time she has been hired to him
as aforesaid, beyond the said five
years as aforsaid, during her ille-
gal detention so wrong fully com
mitted as aforesaid; that he be
enjoined and restrained from paying
to the Defendant Francis BFrancis B Jameson . JamesonFrancis B Jameson
any of the value of the said service
as aforesaid which may now be

Your petitioner, LouisaLouisa , a woman of colour,
states that about seventeen years ago, to wit:
about the seventh day of march eighteen hundred and thirty six, being then owned and possessed
as a slave by Mount St. Mary's College, near
Emmitsburg, in the county of FrederickFrederick , state
of MarylandMaryland, and the said College being at that
time indebted to Francis B. JamesonFrancis B Jameson , the former
President thereof, for money advanced by him for
the same, an agreement was there entered into
between them that she should serve him for
five years to pay the sum of two hundred and
fifty dollars for money so advanced, and that
at the expiration of the said five years she
was to be free; that by virtue and in pursuance
of said agreement she was transferred and
delivered into the possession of the said FrancisFrancis B Jameson
B. JamisonFrancis B Jameson by the said College at the time
aforesaid, and then commenced serving him;
that the said Francis B. JamisonFrancis B Jameson was then a
resident of the state of MarylandMaryland and continued
to be for five or six years or between five and six
years, during all of which time she continued
to serve him; that he then changed his residence
to the state of MissouriMissouri and removed her with him
to the said State, where he has since residend and
now continues to reside; that since said removal
from the state of MarylandMaryland to the state of MissouriMissouri
the said Francis B. JamisonFrancis B Jameson has continued to claim
and hold her, and now claims her as a slave;
that during most or all of said time last aforesaid
to wit: for about eleven or twelve years, or between
eleven and twelve years She has been hired
and is now hired by the said Francis BFrancis B Jameson .

MissouriMissouri aforesaid, in virtue of which she is
now in the possession of th esaid Edmund HEdmund H McCabe .
McCabeEdmund H McCabe and held by him in slavery.

Your Petitioner further state that whilst
in the state of MarylandMaryland, and whilstserving
the said Francis B. JamisonFrancis B Jameson in said state as
aforesaid, she was informed by an officer or
officers of said Mount St Mary's College that
the said agreement in terms as aforesaid and
upon the condition aforesaid was entered in
writing upon the books of the said College;
that she went to the said College to inquire
about it and did inquire of then Procurator
of the College whether the same was so enforced and was
informed by him that if could be found; but that
the books had been torn and defaced so that
no records of that date could be found; that
she was afterwards informed by the officers of the
said College and by the President thereof who
came into office after the [ reliving ] of the said
Francis B. JamisonFrancis B Jameson from the same position, that
the said agreement in terms aforesaid had been
made between the said Francis B. JamisonFrancis B Jameson and
the said College and that the same had been
entered in writing on the Books of the said College;
She was further informed by the sisters of CharityCharity
that the said books had been burned and
destroyed or so defaced that no record of that
date could be found

your Petitioner further states that she
has been informed in this state, and but a
short time since through the said President
who su since the removal of the said Francis BFrancis B Jameson .
JamisonFrancis B Jameson from the state of MarylandMaryland to the

State of MissouriMissouri, she has been informed in
this state thhrough the said President who
succeeded the said Francis B. JamesonFrancis B Jameson as aforesaid,
and by others cognizant of the facts, that the
agreement aforesaid in terms aforesaid and upon
the express condition and premise aforesaid was made
between the said Francis B JamisonFrancis B Jameson and the
said College, and had been entered in writing
in the books thereof, and that some trace or
memorandum thereon ought to be found, but that
your petitioner has caused examination to be
made and has not yet been able to find such
trace or memorandum.

Your Petitioner further states that she
has been in this state, and but a
short time since, through the said President who
succeeded the said Francis B. JamesonFrancis B Jameson , that
the infromation given by him last aforesaid is
correct, and has been more and more impressed on
his mind, and that the books of the said
College to in writing the information,
and that he still believed it could be found;
and further that his strong impression has
been and is that a bill of sale was given by the
said College to the said Francis B. JamesonFrancis B Jameson ,
stating the said agreement in terms aforesaid
and upon the express condition and premise
aforesaid; and that the same was more strongly
impressed upon his mind by the fact of the same
kind of transction, at that time, between the
Said College and another person, a creditor of
the college, in relation to a negro child who
became free in accordnce therewith.

Your petitioner further states that of
her own knowledge the fact last above stated is

true, and that, in substance, all of said
information conformes to her own knowledge of the
said agreement between the said college and
the said Francis B. JamesonFrancis B Jameson , in the terms
aforesaid, and upon the express condition and
premise as aforesaid, and that she has never
had, and has not now, any other understanding
of it.

Your Petitioner further states that the
foregoing is the the ground on which her claim to
freedom is founded, and prays for leave
to sue as a poor person in order to establish
her right to freedom.
