The problem in the South of voting was uh primarily a problem literacy test and the way in which they were administered. You had black Ph.Ds who couldn't pass a literacy test and you had whites who could barely write their name, if they could write it who had no problem being registered to vote. The justice department was empowered by earlier legislation to sue, but it had to sue on behalf of individuals who were discriminated against when they attempt to register to vote.
