Whereas at our Circuit CourtCircuit Court begun and held at the City of St LouisSaint Louis within and for theCounty of St LouisCounty of St Louis on the fourth Monday of July in the Year of Our Lord One Thousand Eight Hundred and twenty nine before the Honorable WilliamWilliam C CarrCarr Judge of the third Judicial Circuit of the MissouriState of Missouri the Grand Jury sworn and Empanneled for the, body of the County of St LouisCounty of St Louis returned into the said court an indictment against HenryHenry a Slave of William ClarkWilliam Clark for Larceny which said indictment was endorsed by the foreman of the said Grand Jury "a true bill" and whereas also at the November Term of the said Circuit CourtCircuitCircuit CourtCourt in the year of our Lord One thousand Eight hundred and twenty nine on the fourteenth day of December in the year aforesaid Arthur L MagenisArthur L Magenis in open Court entered into Recognizance for the appearance of the said HenryHenry at the neat March term of the said court to be held at the city of St LouisSaint Louis within and for the County of Saint LouisCounty of Saint Louis on the fourth Monday of March then next which said Recognizance is in the words and figures following to writs "Arthur L MagenisArthur L Magenis acknowledges himself to be indebted to the MissouriState of Missouri in the sum of One Hundred dollars to be levied of his goods and chattels lands and tenements if HenryHenry a slave shall fail in the condition underwritten, the condition of this Recognizance is such that if the above named HenryHenry shall be and appear on the firstday of the next term of this court to be held at the city of St LouisSt Louis within and for the County of St LouisCounty of St Louis on the fourth Monday of March next then and there to answer to an indictment found against him for Larceny and shall not depart the court without leave then this Recognizance to be void else to remain in full force which said Recognizance above recited remains of Record in our said court, and whereas also at the saidMarch Term of the said Circuit CourtCircuit Court in theYear Eighteen hundred and thirty the said Arthur L. Magenis although solumnly called to bring into Court the body of the said HenryHenry according to the condition of his said Recognizance come not but made default and failed therein therefore it was considered by the said court that the said Recognizance of the said Arthur L MagenisArthur L Magenis be forfeited as by the Record of the said Recognizance and the procep thereon still remain-ing of Record in our said Circuit CourtCircuit Court at the County aforesaid will mournfully appears and though the Recognizance of the said Arthur L. Magenis was forfeited as aforesaid yet he the said Arthur L MagenisArthur L Magenis hath not yet paid the said sum of One Hundred dollars or any part thereof and being willing that what is right in this behalf should be done command you that by lawful men of your county you make known to the said Arthur L MagenisArthurArthur L MagenisL Magenis that he be and appear before the Judge of our Circuit CourtCircuit Court at the next term thereof to be held at the City of St LouisCity of St Louis within and for the County of St LouisCounty of St Louis on the fourth Monday of July next then and there to show cause if any he has or know of any thing to say why the said MissouriState of Missouri should not have execution thereof against him of the debt in for m aforesaid acknowledged according to the form and effect of the said Recog- nizance if it shall beexpedient so to do and have you then there this writ and the namesof the persons by whom you make known to him this writ.
